These Terms of Service (“Terms”) govern your use of the MeroNEP mobile app (“App”) operated by WSN IT Consulting (“we,” “our,” “us”). By accessing or using the App, you agree to comply with these Terms. If you do not agree with any part of these Terms, you must discontinue using the App.
1. Overview of Services
MeroNEP is a social platform designed to connect the Nepalese community in the U.S. through social networking, business listings, and community engagement. The App provides the following services:
- Forum: Users can create posts, comment, reply, and share within categorized sections such as jobs, rooms, rides, immigration, community, business, and general.
- Directory: Business owners and organizations can create and manage business listings.
- Listings: Users can post and browse items for sale or trade.
- Threads: MeroNEP admins post topics for users to engage with and share thoughts.
- Events: Admins post upcoming events, and users can engage with event content.
- Direct Messaging: Users can send private messages to one another.
- Filtering: Users can filter posts and listings based on their state or location.
2. Account Registration and Management
2.1 Eligibility
You must be at least 18 years old to create an account and use the App. By using the App, you confirm that you are legally able to enter into a binding agreement.
2.2 Account Information
To create an account, you must provide your full name, email address, and password. You may also provide a phone number, mailing address, and profile picture, but these are optional.
You are responsible for maintaining the confidentiality of your login credentials. You agree not to share your account details with others or allow others to use your account. You must immediately notify us if you suspect unauthorized access to your account.
2.3 Account Termination
You may delete your account at any time through the App settings. We reserve the right to suspend or terminate your account if you violate these Terms, engage in prohibited activities, or create a security risk for the App or other users.
3. User Conduct and Responsibilities
You agree to use the App in a manner consistent with all applicable laws and regulations. You are solely responsible for the content you create and the interactions you have with other users.
3.1 Prohibited Conduct
You may not:
- Post or share content that is illegal, harmful, defamatory, obscene, offensive, or harassing.
- Engage in hate speech, threats, or any form of discrimination.
- Post false or misleading information.
- Attempt to impersonate another person or misrepresent your affiliation with any entity.
- Upload malware, viruses, or other harmful code.
- Use automated means (such as bots or scripts) to interact with the App.
- Violate the privacy or rights of other users.
- Collect personal information from other users without their consent.
- Post or sell prohibited items such as drugs, firearms, counterfeit goods, or stolen property.
- Attempt to disrupt the App’s functionality or security.
3.2 User-Generated Content
You are solely responsible for the content you post, including forum posts, comments, listings, and direct messages. By posting content, you grant MeroNEP a non-exclusive, royalty-free, worldwide license to display, modify, and distribute your content within the App for the purpose of operating and improving the service.
We reserve the right to remove any content that violates these Terms, infringes on intellectual property, or is otherwise harmful to the community.
4. Business Listings
4.1 Business Listing Creation
Business owners can create business listings by providing details such as the business name, category, contact information, description, and business hours.
4.2 Claiming a Listing
Business owners may claim an existing business listing by verifying their ownership. We may require supporting documentation to verify ownership before granting edit access.
4.3 Business Content Responsibility
Business owners are responsible for the accuracy of the information they provide. Misleading, false, or outdated business information may result in the removal of the listing.
5. Direct Messaging
The direct messaging feature allows users to communicate privately within the App.
- Messages are not encrypted and may be reviewed if reported for violating these Terms.
- Harassment, threats, and abusive behavior within direct messages are strictly prohibited.
- Users can block others from sending messages through the App settings.
- We reserve the right to limit or disable messaging for users who misuse this feature.
6. Intellectual Property
6.1 Ownership
All intellectual property rights related to the App, including but not limited to the design, content, graphics, trademarks, and software, are owned by WSN IT Consulting or licensed to us.
You may not copy, modify, distribute, or reproduce any part of the App without our prior written permission.
6.2 User Content
By submitting content to the App (e.g., posts, listings, comments), you grant MeroNEP a non-exclusive, worldwide, royalty-free license to use, display, reproduce, modify, and distribute that content for the purpose of operating and improving the App.
7. Privacy
Your use of the App is governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using the App, you agree to the terms of our Privacy Policy.
8. Reporting and Enforcement
8.1 Reporting Violations
You may report inappropriate content, harassment, or other violations of these Terms through the App’s reporting feature or by contacting our support team.
8.2 Enforcement
We reserve the right to remove content, suspend accounts, and terminate access to the App if you violate these Terms or engage in prohibited activities. Decisions related to enforcement are final and made at our sole discretion.
9. Disclaimers and Limitations of Liability
9.1 No Warranty
The App is provided “as is” and “as available” without any warranties, express or implied. We do not guarantee that the App will be error-free, secure, or uninterrupted.
9.2 Limitation of Liability
To the extent permitted by law, WSN IT Consulting is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the App. This includes but is not limited to damages for loss of profits, data, or goodwill.
9.3 User Interactions
We are not responsible for the actions or content of other users. Any disputes between users should be resolved directly between them.
10. Indemnification
You agree to indemnify and hold harmless WSN IT Consulting, its affiliates, and employees from any claims, damages, or expenses arising from your use of the App or your violation of these Terms.
11. Changes to These Terms
We may update these Terms periodically. The “Effective Date” at the top of this document reflects the latest revision. Continued use of the App after changes are made constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any legal action arising from these Terms shall be brought in the state or federal courts located in Texas.
